Terms of sale

General Terms
The terms of sale apply to the rights and obligations arising from the purchase of goods between the customers of the Fertago.eu online store (hereinafter the Customer) and Fertago OÜ (hereinafter Fertago.eu).
By registering as a user of Fertago.eu and/or purchasing products, the terms of this contract and the rights and obligations arising from the legal acts of the Republic of Estonia apply.
Fertago.eu reserves the right to make changes to the terms of sale and selling prices. Said changes will be reflected on the Fertago.eu website.

Entry into Force of the Contract of Sale
Fertago.eu sells and the Customer purchases products offered in the e-store.
The contract of sale between Fertago.eu and the Customer enters into force when the amount payable according to the order confirmation is received in the bank account of Fertago OÜ.
By placing an order and making a payment in the Fertago.eu online store, the Customer confirms that they have read and agree to the terms of sale.

Prices
All prices in the Fertago.eu online store are in Euros and include VAT.
Fertago.eu reserves the right to adjust prices. If the Customer placed their order before the price changes took effect, the price reflected on the invoice at the moment of placing the order will apply to them. The Customer does not have the right to demand compensation for the price difference.

Placing an Order and Paying for Goods
When paying for the order, the Customer can choose a suitable payment method: Prepayment invoice or bank link.
Supported Estonian bank links: Swedbank, SEB, Luminor, Danske, LHV, Coop, Pocopay, and Liisi ID.
Supported Finnish bank links: Aktia, Ålandsbanken, Danske, Handelsbanken, Nordea, Oma Säästöpankki, Pohjola, POP Pankki, S-Pankki, Säästöpankki.
Supported bank cards: Visa, Mastercard, Maestro.
The payment takes place outside the Fertago.eu e-store environment through Montonio Finance OÜ. The Fertago.eu e-store does not have access to the customer's bank and credit card details. After paying for the product, please be sure to click the "Return to merchant" button in the bank. Payments are made in euros.
The Customer pays 100% of the order amount to confirm the order.
The sales contract is considered concluded and order processing begins immediately after the Customer has paid 100% of the order confirmation.
Coupons – During various campaigns, we offer discount coupons to customers. We share coupons in newsletters, social media (Facebook), and on the website. The terms and deadlines for using a coupon are specified separately with each discount coupon.

Delivery
After the sales contract enters into force (Customer's payment of the invoice), Fertago.eu processes the order and delivers the product within the delivery time specified with the product.
The delivery terms shown on the Fertago.eu website apply from the moment the invoice is paid.
The Customer is obliged to inform Fertago.eu immediately of any changes to the destination or agreed time before the goods are delivered.
Avoiding delays and misunderstandings in delivering goods depends on the accuracy and correctness of the data provided in the order. Fertago.eu is not responsible for delayed delivery or misunderstandings if they are caused by inaccurate data provided by the Customer when placing the order.
Shipments damaged during transport (where the products, but not the product packaging, have been damaged) will be replaced. If replacement proves impossible, we offer compensation for the cost of the damaged goods.
Products generally reach the customer within 7–10 working days. The specific delivery time is indicated next to each product. Our logistics partners are AS Eesti Post, Itella Estonia OÜ, DPD Eesti AS.

Right of Return
According to § 56 (1) of the Law of Obligations Act (LOA), a private customer has the right to withdraw from the contract within 14 days of receiving the goods.
Returned goods must be unused, undamaged, and in their original packaging.
The return costs are borne by the customer (max. €10, LOA § 194 (4)), except in cases where the reason for return is non-compliance with the order or a defective product.
To return goods, a return application must be submitted to the e-mail address info@fertago.eu within 14 days of receiving the goods. The return application must include the Customer's name, product name, and the reason for the return.
The returned goods must reach Fertago.eu within 14 days after the customer has withdrawn from the contract.
The money for the returned goods will be refunded to the Customer after the returned goods have been checked, but no later than within 14 days.

Procedure for Submitting Claims
According to the Law of Obligations Act, the Customer has the right to submit claims regarding non-compliance with the contract terms for 2 years from the receipt of the goods. For defects occurring during the first six months, it is presumed that the defect existed at the time of purchase, and the nature of the defect must be determined by the seller.
If a product defect appears, the Customer is obliged to notify Fertago.eu of the problem at info@fertago.eu and provide the following information: name, contact details, and product defect. The corresponding application must be sent no later than within 2 months after discovering the defect.
Fertago.eu is not liable for:
Product damage caused by the Customer's fault or negligence.
Defects resulting from improper use of the product.
Natural physical wear and tear of the product during normal use.

Liability and Force Majeure
Fertago.eu is liable to the Customer, and the Customer is liable to Fertago.eu for damage caused to the other party by violating these terms in the cases and to the extent provided by the legal acts of the Republic of Estonia.
Fertago.eu is not liable for damages caused to the Customer or for delays in product delivery if the damage or delay is caused by circumstances beyond Fertago.eu's control or foreseeability.

Privacy
By using the Fertago.eu website, the Customer gives clear and informed consent to Fertago.eu to process their personal data.
Fertago.eu uses the information provided by the Customer only to fulfill the Customer's purchase order and does not disclose it to third parties.
Fertago.eu is committed to protecting the privacy of customers and users. Accordingly, we have drawn up these privacy policy principles, which address the collection, use, disclosure, transmission, and storage of customer data. Our activities on the Internet comply with all relevant activities and corresponding European Union legislation and laws of the Republic of Estonia. Please take a moment to read our privacy principles.

Collection and Use of Personal Data
Personal data is data that Fertago.eu collects to perform a contract entered into with an individual or to contact them.
The collection of a loyal customer's personal data may occur in the following ways:
• When submitting contact information (including your name, personal identification code, postal address, phone number, e-mail address, preferred contact method) on our website
• When using the website from the customer's account information or through cookies
• When making a purchase or order in our store or e-store, storing personal contact details or purchasing preference data (Fertago.eu may ask you to voluntarily provide personal data and personal information in certain areas of the website. Required personal data may include name, address, postal code, e-mail address, phone number, and other data)

Collection of Other Data
We also collect non-personal data – data that cannot be directly linked to a specific person (gender, age, language preference, location).
